CAN-SPAM Act

The US law governing commercial email, setting rules for honest headers, clear identification, valid opt-out, and a physical address.

The CAN-SPAM Act is the United States federal law that sets the rules for commercial email, including cold outbound. Enforced by the Federal Trade Commission, it does not require prior consent to send a first message, but it does mandate honesty and a clean exit. Penalties for violations can run into the tens of thousands of dollars per email, so compliance is not optional for a serious program.

Why it matters for outbound

CAN-SPAM is the legal floor for US outbound. Because the law permits cold email when its conditions are met, it is the framework that lets compliant prospecting happen at all in the United States. Ignoring it exposes the client to fines and the program to blocks, since mailbox providers treat the same behaviors the law targets, deceptive headers and missing opt-outs, as spam signals that wreck deliverability.

Core requirements

  • Header and "From" information must be accurate and not misleading
  • Subject lines must reflect the actual content of the message
  • The message must identify itself as a solicitation where required
  • A clear, working opt-out mechanism must be present in every email
  • Opt-out requests must be honored promptly, within ten business days
  • A valid physical postal address must appear in the message
